IMAGE LICENSE

Unless otherwise agreed on the standard license will be for use on client's company's website, social media pages, event presentation bio photos, and marketing materials (direct mail, email promos, etc). The images may be used on the inside or back of a book jacket, but not as the cover.  Third party use of any kind is not allowed. This means client can not give the image to anyone else to use in any way or in any type of media.  Additionally client can not use the images in any paid advertising. These licenses are available if you need them at and additional fee.

 

Darnell Kemp retains the right to use all images on his website and in any marketing and advertising for his business. He also retains the rights to use the images in any way allowed as the copyright owner.  This includes licensing images for editorial uses.  It does not include third party commercial advertising use.

MODEL/CLIENT RELEASE

In consideration of clients engagement as a model, and for other good and valuable consideration herein acknowledged as received, client hereby grants the following rights and permissions to Darnell Kemp ("Photographer"), his/her heirs, legal representatives, and assigns, those for whom Photographer is acting, and those acting with his/her authority and permission. They have the irrevocable, perpetual and unrestricted right and permission to take, use, re-use, publish, and republish photographic portraits or pictures of me or in which I may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with my own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium at his/her studios or elsewhere, and in any and all media now or hereafter known, specifically including but not limited to print media and distribution over the internet for illustration, promotion, art, editorial, advertising, trade, or any other purpose whatsoever.

Client specifically consents to the digital compositing or distortion of the portraits or pictures, including without restriction any changes or alterations as to color, size, shape, perspective, context, foreground or background. Client also consents to the use of any published matter in conjunction with such photographs. Client hereby waives any right that client may have to inspect or approve the finished product or products and the advertising copy or other matter that may be used in connection with them or the use to which they may be applied. Client hereby releases, discharges, and agrees to hold harmless Photographer, his/her heirs, legal representatives, and assigns, and all persons acting under his/her permission or authority or those for whom he/ she is acting, from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of such photographs or in any subsequent processing of them, as well as any publication of them, including without limitation any claims for libel or violation of any right of publicity or privacy.

TEXT LICENSE

In case of text submission, author hereby grants and assigns to Darnell Kemp and Darnell Kemp Photography - DKSnapix the exclusive, sole, permanent, world-wide, transferable, sub-licensable and unlimited right to reproduce, publish, distribute, transmit, make available or otherwise communicate to the public, translate, publicly perform, archive, store, lease or lend and sell the Work or parts thereof individually or together with other works in any language, in all revisions and versions (including soft cover, book club and collected editions, anthologies, advance printing, reprints or print to order, microfilm editions, audiograms and videograms), in all forms and media of expression including in electronic form (including offline and online use, push or pull technologies, use in databases and data networks(e.g. the Internet) for display, print and storing on any and all stationary or portable end-user devices, e.g. text readers, audio, video or interactive devices, and for use in multimedia or interactive versions as well as for the display or transmission of the works or parts thereof in data networks or search engines, and posting the Work on social media accounts closely related to the Work), in whole, in part or in abridged form, in each case as now known or developed in the future, including the right to grant further time-limited or permanent rights.
